A BILL TO BE ENTITLED
AN ACT
relating to the authority of the State Office of Administrative
Hearings to conduct certain hearings over which the Railroad
Commission of Texas has jurisdiction.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. The following are repealed:
(1) Section 102.006, Utilities Code; and
(2) Section 2003.0491, Government Code.
SECTION 2. (a) This Act takes effect immediately if it
receives a vote of two-thirds of all the members elected to each
house, as provided by Section 39, Article III, Texas Constitution.
If this Act does not receive the vote necessary for immediate
effect, this Act takes effect September 1, 2003.
(b) This Act applies to a hearing pending before the State
Office of Administrative Hearings on the effective date of this Act
under Section 102.006, Utilities Code, as that section existed
immediately before the effective date of this Act. A hearing
pending before the State Office of Administrative Hearings on the
effective date of this Act under Section 102.006, Utilities Code,
is transferred to the Railroad Commission of Texas on that date.
