A BILL TO BE ENTITLED
AN ACT
relating to the transfer of the powers, duties, and functions under
the Texas Aggregate Quarry and Pit Safety Act from the railroad
commission to the department of transportation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. On the effective date of this Act:
(1) all powers, duties, functions, and activities
performed by the Railroad Commission of Texas under Chapter 133,
Natural Resources Code, immediately before the effective date of
this Act are transferred to the Texas Department of Transportation;
(2) all employees of the Railroad Commission of Texas
whose primary duties relate to the implementation of Chapter 133,
Natural Resources Code (Texas Aggregate Quarry and Pit Safety Act),
become employees of the Texas Department of Transportation;
(3) a rule, form, order, or procedure adopted by the
Railroad Commission of Texas for the implementation or enforcement
of Chapter 133, Natural Resources Code (Texas Aggregate Quarry and
Pit Safety Act), is a rule, form, order, or procedure of the Texas
Department of Transportation and remains in effect until changed by
the Texas Department of Transportation;
(4) a reference in Chapter 133, Natural Resources
Code, to the Railroad Commission of Texas means the Texas
Department of Transportation;
(5) a permit or certification in effect under Chapter
133, Natural Resources Code, that was issued by the Railroad
Commission of Texas is continued in effect as a permit or
certification issued by the Texas Department of Transportation; and
(6) a complaint, investigation, or other proceeding
under Chapter 133, Natural Resources Code, pending before the
Railroad Commission of Texas is transferred without change in
status to the Texas Department of Transportation.
SECTION 2. This Act takes effect September 1, 2003.
