A BILL TO BE ENTITLED
AN ACT
relating to coordination of inspections of certain licensed
child-care facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Sections 42.0442(a), (b), and (c), Human
Resources Code, are amended to read as follows:
(a) The department shall coordinate monitoring inspections
of licensed day-care centers, licensed group day-care homes, and
registered family homes performed by another state agency or a
political subdivision of the state to eliminate redundant
inspections.
(b) The department shall form a [an interagency] task force
consisting of representatives of [with] the Texas Department of
Health, the Texas Department of Human Services, [and] the Texas
Workforce Commission, and political subdivisions to develop an
inspection protocol that will coordinate inspections by those
agencies and political subdivisions. The protocol must assign the
required items for inspection by each agency or political
subdivision and facilitate the sharing of inspection data and
compliance history.
(c) The [interagency] task force shall establish an
inspection checklist based on the inspection protocol developed
under Subsection (b). Each state agency or political subdivision
that inspects a facility listed in Subsection (a) shall use the
inspection checklist in performing an inspection. A state agency
or political subdivision shall make a copy of the completed
inspection checklist available to the facility at the facility's
request to assist the facility in maintaining records.
SECTION 2. (a) This Act takes effect immediately if it
receives a vote of two-thirds of all the members elected to each
house, as provided by Section 39, Article III, Texas Constitution.
If this Act does not receive the vote necessary for immediate
effect, this Act takes effect September 1, 2003.
(b) Not later than June 1, 2004:
(1) the Department of Protective and Regulatory
Services shall complete development of the inspection protocol
required by Section 42.0442(b), Human Resources Code, as amended by
this Act, and establishment of the inspection checklist required by
Section 42.0442(c), Human Resources Code, as amended by this Act;
and
(2) each political subdivision of this state shall
begin using the inspection checklist as required by Section
42.0442(c), Human Resources Code, as amended by this Act.
