A BILL TO BE ENTITLED

AN ACT

relating to the creation of an inspection information database for 
commercial motor vehicles.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter D, Chapter 548, Transportation Code, 
is amended by adding Section 548.204 to read as follows:
	Sec. 548.204.  INSPECTION INFORMATION DATABASE. (a)  The 
department shall establish a computerized database containing the 
information from each inspection of a commercial motor vehicle.
	(b)  On request of a law enforcement agency or other person 
the department by rule determines has a legitimate need for the 
information, the department shall provide information from the 
database about a commercial motor vehicle's inspection record.
	SECTION 2.  Subchapter H, Chapter 548, Transportation Code, 
is amended by adding Section 548.5056 to read as follows:
	Sec. 548.5056.  INSPECTION INFORMATION DATABASE FEE.  In 
addition to other fees required by this subchapter, to fund the 
inspection information database established under Section 548.204, 
the department shall collect for every commercial motor vehicle 
required to be inspected under Subchapter D a reasonable fee in an 
amount prescribed by the department as necessary to recover the 
costs of administering that section.
	SECTION 3.  This Act takes effect September 1, 2003.
