A BILL TO BE ENTITLED

AN ACT

relating to the applicability of Chapter 49, Texas Water Code 
Subchapter I, to certain services to comply with federal and state 
construction stormwater requirements.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Chapter 49, Water Code, is amended by adding 
Section 49.278 to read as follows:
	Sec. 49.278.  NONAPPLICABILITY.  (a)  This subsection does 
not apply to:
		(7)  services or contract for services related to 
complying with any state or federal construction storm water 
requirements, including obtaining permits and implementing any 
required best management practices.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
