A BILL TO BE ENTITLED
AN ACT
relating to allowing groundwater conservation districts to define waste by local rule. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 36.101, Water Code, is amended by adding Subsection (d) to read as follows: (d) A district may adopt and enforce a rule that defines waste to include the use of groundwater to fill or maintain a lake, pond, or fountain the water in which is used in place solely for purposes of landscape enhancement. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
