A BILL TO BE ENTITLED
AN ACT
relating to a person knowingly bartering or expending funds derived from the commission of an offense, providing penalties. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 481.126, Health and Safety Code is amended as follows: 481.126. Offense: Illegal Expenditure or Investment (a) A person commits an offense if the person: (1) expends funds or barters property the person knows are derived from the commission of an offense under this chapter punishable by imprisonment in the institutional division of the Texas Department of Criminal Justice for life; [or] (2) expends funds or barters property the person knows are derived from the commission of an offense under 481.121(b)(5); (3) finances, [or] invests funds or barters property the person knows or believes are intended to further the commission of an offense for which the punishment is described by Subdivision (1); or (4) finances, invests funds or barters property the person knows or believes are intended to further the commission of an offense for which the punishment is described by Subdivision (2). (b) An offense under Subsection (a)(1) or (3) [this section] is a felony of the first degree. (c) An offense under Subsection (a)(2) or (4) is a felony of the second degree. SECTION 2. This Act takes effect September 1, 2003.
