A BILL TO BE ENTITLED
AN ACT
relating to the operations of the Commission on Jail Standards.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 511.003, Government Code, is amended to
read as follows:
Sec. 511.003. SUNSET PROVISION. The Commission on Jail
Standards is subject to Chapter 325 (Texas Sunset Act). Unless
continued in existence as provided by that chapter, the commission
is abolished and this chapter expires September 1, 2007 [2009].
SECTION 2. Section 511.0093(a), Government Code, is amended
to read as follows:
(a) The commission may impose a reasonable fee on a private
vendor that operates a correctional facility housing prisoners from
jurisdictions other than this state. The fee must reasonably
compensate the commission for the cost of regulating and providing
technical assistance to the facility.
SECTION 3. Section 511.0101(b), Government Code, is amended
to read as follows:
(b) The commission shall prescribe a form for the report
required by this section. If the report establishes that a county
jail has been operated in excess of its total capacity for four
[three] consecutive months, the commission may consider adoption of
an order to prohibit confinement of prisoners in the county jail
under Section 511.012.
SECTION 4. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
