A BILL TO BE ENTITLED
AN ACT
relating to the state's goal for electrical generation capacity by
renewable energy technologies.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 39.904(a), Utilities Code, is amended to
read as follows:
(a) It is the intent of the legislature that a total of
13,400 [by January 1, 2009, an additional 2,000] megawatts of
generating capacity from renewable energy technologies will have
been installed in this state by January 1, 2019. The cumulative
installed renewable capacity in this state shall total 2,795 [1,280
megawatts by January 1, 2003, 1,730] megawatts by January 1, 2005,
4,310 [2,280] megawatts by January 1, 2007, 5,825 [and 2,880]
megawatts by January 1, 2009, 7,340 megawatts by January 1, 2011,
8,855 megawatts by January 1, 2013, 10,370 megawatts by January 1,
2017, and 13,400 megawatts by January 1, 2019.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
