A BILL TO BE ENTITLED
AN ACT
relating to restricting the state from competing with private enterprise. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. (a) In this Act: (1) "Commercial activity" means performing a service or providing a good that can be obtained from private enterprise. (2) "Private enterprise" means an individual, partnership, association, corporation, or other private legal entity providing goods or services for profit. (b) The state may not engage in any commercial activity, including manufacturing, processing, managing, selling, leasing, delivering, distributing, or advertising, wholly or partly, any goods or services to or for governmental entities or to or for public use. SECTION 2. This Act takes effect September 1, 2003.
