A BILL TO BE ENTITLED
AN ACT
relating to the addition of territory to a public improvement
district.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter A, Chapter 372, Local Government
Code, is amended by adding Section 372.0125 to read as follows:
Sec. 372.0125. ADDITION OF TERRITORY. (a) A municipality
may add territory in the municipality or the extraterritorial
jurisdiction of the municipality to a public improvement district
created by the municipality only if requested by a petition signed
by:
(1) owners of taxable real property representing more
than 50 percent of the appraised value of taxable real property
liable for assessment in the area to be added, as determined by the
current roll of the appraisal district in which the property is
located; and
(2) record owners of real property liable for
assessment in the area to be added who:
(A) constitute more than 50 percent of all record
owners of property that is liable for assessment in the area to be
added; or
(B) own taxable real property that constitutes
more than 50 percent of the area of all taxable real property that
is liable for assessment in the area to be added.
(b) A county may add territory in the county to a public
improvement district created by the county only if requested by a
petition signed by:
(1) owners of taxable real property representing more
than 50 percent of the appraised value of taxable real property
liable for assessment in the area to be added, as determined by the
current roll of the appraisal district in which the property is
located; and
(2) record owners of real property liable for
assessment in the area to be added who:
(A) constitute more than 50 percent of all record
owners of property that is liable for assessment in the area to be
added; or
(B) own taxable real property that constitutes
more than 50 percent of the area of all taxable real property that
is liable for assessment in the area to be added.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
