A BILL TO BE ENTITLED
AN ACT
relating to the state program of temporary assistance and related support services for needy persons. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 34.002, Human Resources Code, is amended by adding Subsection (d) to read as follows: (d) If federal law is enacted that imposes work participation rate requirements on two-parent families for purposes of the financial assistance program under Chapter 31 that are substantively identical to those that federal law imposes on one-parent families for purposes of that program, the department may, on the effective date of the federal law relating to the work participation rate requirements for two-parent families, provide for establishment of that recipient's eligibility for financial assistance under Chapter 31 instead of under this chapter in a manner that avoids disruption of benefits for which the recipient is eligible. SECTION 2. Section 34.007, Human Resources Code, is amended to read as follows: Sec. 34.007. REPORT. The Health and Human Services Commission, the department, and the Texas Workforce Commission shall monitor implementation and operation of the state program and, not later than September 1 of each year, jointly report to the governor, the legislature, and the Legislative Budget Board on the status and use of the state program. [The report required to be submitted not later than September 1, 2002, must include: [(1) an analysis of whether the state program has effectively met the goals of the program, including improved delivery of services to program recipients; and [(2) recommendations regarding continuation of the program.] SECTION 3. Section 5, Chapter 1440, Acts of the 77th Legislature, Regular Session, 2001, is repealed. SECTION 4. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
