A BILL TO BE ENTITLED

AN ACT

relating to the authorization of donations to state programs by 
pharmaceutical manufacturers or other private entities.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 531.038. Government Code is amended by 
adding subsection (b) to read as follows:
	Sec. 531.038. Gifts and Grants.  (a)  The commission may 
accept a gift or grant from a public or private source to perform 
any of the commission's powers or duties.
	(b)  Notwithstanding any current law, rule or regulation to 
the contrary, a pharmaceutical manufacturer, distributor, 
provider, or other third party may make contributions of money, 
drugs, equipment, or any other item of value to any state agency, 
subject to the written approval of the Health and Human Services 
Commissioner.  The Commission may adopt rules and procedures to for 
the implementation of this provision.
	SECTION 2.  This Act takes effect September 1, 2003.
