A BILL TO BE ENTITLED
AN ACT
relating to the disclosure of business or financial relationships
by certain governmental officers associated with sports
authorities; imposing a criminal penalty.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter F, Chapter 335, Local Government
Code, is amended by adding Section 335.1085 to read as follows:
Sec. 335.1085. DISCLOSURE OF FINANCIAL OR BUSINESS
RELATIONSHIP. (a) This section applies to:
(1) a director;
(2) the mayor or county judge who appointed the board;
and
(3) each member of the governing body of the
municipality or county that created the district.
(b) In addition to the requirements of Chapter 171 and
Section 335.108 and the requirements of Chapters 553 and 573,
Government Code, a person to whom this section applies shall
disclose any financial or other business relationship that the
person has with any person doing business with the district.
(c) A person to whom this section applies shall make the
disclosure in writing:
(1) to the board; and
(2) to the Texas Ethics Commission.
(d) The board shall enter the disclosure received under
Subsection (c) in the board's minutes.
(e) A director who makes a disclosure under this section may
not vote or participate in any action related to the person about
whom the director made the disclosure.
(f) A person to whom this section applies commits an offense
if the person fails to make the disclosure required by this section.
The offense is a third degree felony.
SECTION 2. This Act does not apply to an action taken, or
disclosure required, before November 1, 2003, by a person to whom a
disclosure or action is required under Section 335.1085, Local
Government Code, as added by this Act. An action taken by the
person before November 1, 2003, is governed by the law as it existed
immediately before November 1, 2003, and that law is continued in
effect for that purpose.
SECTION 3. This Act takes effect September 1, 2003.
