A BILL TO BE ENTITLED
AN ACT
relating to the disclosure of business or financial relationships by directors of sports authorities; imposing a criminal penalty. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter F, Chapter 335, Local Government Code, is amended by adding Section 335.1085 to read as follows: Sec. 335.1085. DISCLOSURE OF FINANCIAL OR BUSINESS RELATIONSHIP. (a) In addition to the requirements of Chapter 171 and Section 335.108 and the requirements of Chapters 553 and 573, Government Code, a director shall disclose any financial or other business relationship that the director has with any person doing business with the district. (b) The director shall make the disclosure: (1) in the board's minutes; and (2) to the Texas Ethics Commission. (c) A director who makes a disclosure under this section may not vote or participate in any action related to the person about whom the director made the disclosure. (d) The director commits an offense if the director fails to make the disclosure required by this section. The offense is a third degree felony. SECTION 2. This Act takes effect September 1, 2003, and applies to any action taken, or disclosure required, by a director of a sports and community venue district created under Chapter 335, Local Government Code, on or after November 1, 2003. An action taken by a director or employee of a sports and community venue district created under Chapter 335, Local Government Code, before November 1, 2003, is governed by the law as it existed immediately before November 1, 2003, and that law is continued in effect for that purpose.
