A BILL TO BE ENTITLED
AN ACT
relating to public notice of groundwater contamination.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter J, Chapter 26, Water Code, is amended
by adding Section 26.408 to read as follows:
Sec. 26.408. NOTICE OF GROUNDWATER CONTAMINATION. (a) If a
state agency documents a case of groundwater contamination where a
drinking water well is threatened under Section 26.406(a), the
state agency shall notify the commission.
(b) On receipt of notice under Subsection (a), the
commission shall notify owners of potentially affected private
drinking water wells by first class mail.
(c) The commission by rule shall prescribe the form and
content of notice required under this section.
SECTION 2. This Act takes effect September 1, 2003, and
applies only to a case of groundwater contamination where a
drinking water source is threatened on or after that date. A case
of groundwater contamination where a drinking water source is
threatened documented before the effective date of this Act is
governed by the law in effect on the date the contamination is
documented, and the former law is continued in effect for that
purpose.
