A BILL TO BE ENTITLED
AN ACT
relating to the evaluation by the Texas Higher Education Coordinating Board of requests by institutions of higher education for special item appropriations. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 61.059, Education Code, is amended by adding Subsection (e-1) to read as follows: (e-1) The board shall evaluate and rank each request for an appropriation for a special item using criteria established by board rule, including criteria related to whether the proposed item would satisfy general board goals for higher education in this state and whether the proposed item would satisfy a unique institutional need that cannot be funded through other means. For each criterion established by the board, the board shall use a range of points to evaluate the degree to which a proposed special item satisfies the criterion and shall rank all special items based on the total points awarded to each special item under this subsection. The board shall include the board's evaluation and ranking of requested special item appropriations in the board's summary and analysis presented to the governor and legislature under Subsection (e) for use in prioritizing and making appropriations under this section. In this subsection, "special item" means a specific activity, program, or facility conducted or operated by an institution of higher education for which the institution requests state funding in the General Appropriations Act from general revenue, other than formula funding. SECTION 2. Section 61.059(e-1), Education Code, as added by this Act, applies only to legislative appropriations made for fiscal years that begin on or after September 1, 2005. SECTION 3. This Act takes effect September 1, 2003.
