A BILL TO BE ENTITLED

AN ACT

relating to energy purchased for charging an energy storage 
facility.       
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter B, Chapter 39, Utilities Code is 
amended by adding Section 39.052(i) to read as follows:
	Sec. 39.052(i).  Energy purchased for charging an energy 
storage facility which is to be discharged for later resale or use 
shall not be treated as final or retail consumption but rather as a 
wholesale transaction.
