A BILL TO BE ENTITLED

AN ACT

relating to notice of renewal or nonrenewal of term contracts of 
certain professional employees of school districts.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Sections 21.206(a) and (b), Education Code, are 
amended to read as follows:
	(a)  Not later than the 60th [45th] day before the first
[last] day of instruction of the following [in a] school year, the 
board of trustees or its designee shall notify in writing each 
teacher whose contract is about to expire whether the board 
proposes to renew or not renew the contract.
	(b)  The [board's] failure to give the notice required by 
Subsection (a) within the time specified constitutes an election to 
employ the teacher in the same professional capacity for the 
following school year.
	SECTION 2.  This Act takes effect September 1, 2003.
