A BILL TO BE ENTITLED
AN ACT
relating to duplicate driver's licenses, the suspension of driver's
licenses, and the suspension of vehicle registrations following
certain suspensions of driver's licenses.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 521.146, Transportation Code, is amended
to read as follows:
Sec. 521.146. APPLICATION FOR DUPLICATE LICENSE OR
CERTIFICATE. (a) If a driver's license or certificate issued under
this chapter is lost or destroyed, or there is a change in pertinent
information, the person to whom the license or certificate was
issued may obtain a duplicate or corrected version.
(b) A person who moves from the address shown on the license
or certificate or changes the person's name must notify the
department of the change and apply for a duplicate license or
certificate not later than the 30th day after the date on which the
change takes effect.
(c) An applicant for a corrected driver's license or
certificate must submit to the department the required fee,
accompanied by the required information that has changed with proof
satisfactory to the department that supports the change.
(d) [(c)] The department by rule may provide that the holder
of a driver's license or identification certificate issued by the
department may apply for the issuance of a duplicate license or
certificate by mail, by telephone, over the Internet, or by other
electronic means.
(e) [(d)] A rule adopted under Subsection (d) [(c)] may
prescribe eligibility standards for issuance of a duplicate
driver's license or identification certificate under this section.
SECTION 2. Section 521.341, Transportation Code, is amended
to read as follows:
Sec. 521.341. REQUIREMENTS FOR AUTOMATIC LICENSE
SUSPENSION. Except as provided by Sections 521.344(d)-(i), a
license is automatically suspended on final conviction of the
license holder of:
(1) an offense under Section 19.05, Penal Code,
committed as a result of the holder's criminally negligent
operation of a motor vehicle;
(2) an offense under Section 38.04, Penal Code, that
was committed while operating a motor vehicle;
(3) an offense under Section 49.04 or 49.08, Penal
Code;
(4) an offense under Section 49.07, Penal Code, if the
person used a motor vehicle in the commission of the offense;
(5) an offense punishable as a felony under the motor
vehicle laws of this state;
(6) an offense under Section 550.021; or
(7) an offense under Section 521.451 or 521.453.
SECTION 3. Section 601.162(b), Transportation Code, is
amended to read as follows:
(b) If a suspension is terminated under Subsection
(a)(3)(C), on notice of a default in the payment of an installment
under the agreement, the department shall promptly suspend the
driver's license and vehicle registration or nonresident's
operating privilege of the person defaulting. A suspension under
this subsection continues until:
(1) the person deposits and maintains security in
accordance with Section 601.153 in an amount determined by the
department at the time of suspension under this subsection and
files evidence of financial responsibility in accordance with
Section 601.153; or
(2) the second anniversary of the date security was
required [deposited] under Subdivision (1) if, during that period,
an action on the agreement has not been instituted in a court in
this state.
SECTION 4. Section 601.340(a), Transportation Code, is
amended to read as follows:
(a) Except as provided by Subsection (b) or (c), the
department shall suspend the registration of each motor vehicle
registered in the name of a person if the department:
(1) under any state law, other than Section
521.341(7) [521.341(6)], suspends or revokes the person's driver's
license on receipt of a record of a conviction or a forfeiture of
bail; or
(2) receives a record of a guilty plea of the person
entered for an offense for which the department would be required to
suspend the driver's license of a person convicted of the offense.
SECTION 5. Sections 521.054, 521.102, and 521.423,
Transportation Code, and Section 522.029(f), Transportation Code,
as added by Chapter 1156, Acts of the 75th Legislature, Regular
Session, 1997, are repealed.
SECTION 6. This Act takes effect September 1, 2003.
