A BILL TO BE ENTITLED
AN ACT
relating to re-codification issues and the deletion of outdated statutes. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 521.146, Transportation Code, is amended to read as follows: Section 521.146. Application for Duplicate License or Certificate (a) If a driver's license or certificate issued under this chapter is lost or destroyed, or there is a change in pertinent information, the person to whom the license or certificate was issued may obtain a duplicate or corrected version. (b) A person who moves from the address shown on the license or certificate or changes the person's name must notify the department of the change and apply for a duplicate license or certificate not later than the 30th day after the date on which the change takes effect. (c) An applicant for a corrected driver's license or certificate must submit to the department the required fee, accompanied by the required information that has changed with proof satisfactory to the department that supports the change. (c) (d) The department by rule may provide that the holder of a driver's license or identification certificate issued by the department may apply for the issuance of a duplicate license or certificate by mail, by telephone, over the Internet, or by other electronic means. (d) (e) A rule adopted under Subsection (c) may prescribe eligibility standards for issuance of a duplicate driver's license or identification certificate under this section. SECTION 2. Section 521.341, Transportation Code, is amended to read as follows: Section 521.341 (2). Requirements For Automatic License Suspension (2) an offense under Section 38.04, Penal Code that was committed while operating a motor vehicle; SECTION 3. Section 601.162 (b)(2), Transportation Code is amended to read as follows: Section 601.162 (b)(2). Duration of Suspension (b)(2) the second anniversary of the date security was depositedrequired under Subdivision (1) if, during that period, an action on the agreement has not been instituted in a court in this state. SECTION 4. Section 601.340 (a)(1), Transportation Code is amended to read as follows: Section 601.340(a)(1). Evidence of Financial Responsibility or Suspension of Vehicle Registration Following Suspension or Revocation of Driver's License (a) Except as provided by Subsection (b) or (c), the department shall suspend the registration of each motor vehicle registered in the name of a person if the department: (1) under any state law, other than Section 521.341(6) (7) suspends or revokes the person's driver's license on receipt of a record of a conviction or a forfeiture of bail; or SECTION 5. Sections 521.054, 521.102, 521.423 and 522.029(f) as added by Acts of the 75th Legislature, regular session, 1997, chapter 1156, Sec. 2, are repealed. SECTION 6. This Act takes effect on September 01, 2003.
