A BILL TO BE ENTITLED

AN ACT

relating to physician and health care provider panels of 
independent review organizations.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 2, Article 21.58C, Insurance Code, is 
amended by adding Subsection (h) to read as follows:
	(h)  Information submitted by an independent review 
organization in an application under Subsection (d) of this section 
or otherwise in accordance with this article that reveals the 
identity of a health care provider or physician making review 
determinations for the organization is confidential as a trade 
secret.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
