A BILL TO BE ENTITLED
AN ACT
relating to the transfer of certain state property from the Texas
Parks and Wildlife Department to the General Land Office.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. (a) On November 1, 2003, the Parks and Wildlife
Department of the State of Texas shall transfer to the General Land
Office of the State of Texas the interest of the Parks and Wildlife
Department in all real property described by Subsection (d) of this
section, including any improvements affixed to the property.
(b) No consideration shall be transferred from the General
Land Office to the Texas Parks and Wildlife Department for such
transfer.
(c) The Parks and Wildlife Department and the Parks and
Wildlife Commission shall transfer their respective interest in the
property by an appropriate instrument of transfer.
(d) The real property to which Subsection (a) of this
section refers is described as (I) all real property to include
improvements thereon and appurtenances thereto currently in the
name of, set aside for the use of, claimed by, under the control of,
or in the possession of the Parks and Wildlife Department of the
State of Texas and (ii) all real property to include improvements
thereon and appurtenances thereto currently in the name of, set
aside for the use of, claimed by, under the control of or in the
possession of the Parks and Wildlife Commission of the State of
Texas.
Section 2. (a) The duties and services of the Parks and
Wildlife Department are not transferred. (b) The duties and
services of the Parks and Wildlife Commission are not transferred.
(c) Uses and purposes of the property transferred hereby shall not
change by this transfer.
SECTION 3. This Act takes effect immediately if it receives
a vote of two thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
