H.B. No. 3179




AN ACT
relating to the elimination of certain membership requirements for local workforce development boards and of certain programs administered by those boards. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 2308.256(b), Government Code, is amended to read as follows: (b) Private sector representatives on the board are selected from individuals nominated by general-purpose business organizations that have consulted with and received recommendations from other business organizations in the workforce development area. [The number of the nominations may not be less than 150 percent of the number of individuals to be appointed under Subsection (a)(1).] The nominations and the individuals selected from the nominations must reasonably represent the industrial and demographic composition of the business community. Not less than one-half of the business and industry representatives must be, if possible, representatives of small businesses, including minority businesses. SECTION 2. The following laws are repealed: (1) Section 2308.3036, Government Code; (2) Section 2308.3037, Government Code; and (3) Section 2308.3038, Government Code. SECTION 3. (a) The local workforce development board demonstration project program established under Section 2308.3036, Government Code, is abolished on the effective date of this Act. (b) All unobligated and unexpended balances in the local workforce development board demonstration project fund account created under Section 2308.3037, Government Code, as that section existed immediately before repeal by this Act, are transferred on the effective date of this Act to the general revenue fund. SECTION 4. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003. ______________________________ ______________________________ President of the Senate Speaker of the House I certify that H.B.
