A BILL TO BE ENTITLED
AN ACT
relating to electing directors of the Blanco-Pedernales Groundwater Conservation District. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. DEFINITIONS. In this Act: (1) "District" means the Blanco-Pedernales Groundwater Conservation District. (2) "Board" means the board of directors of the Blanco-Pedernales Groundwater Conservation District. SECTION 2. BOARD RESOLUTION. After a public hearing regarding the methods for electing the directors of the district described by Section 3 of this Act, the board by resolution may determine which electoral method authorized by Section 3 of this Act shall be used to elect the directors of the district. SECTION 3. ELECTION OF DIRECTORS. (a) The directors of the district may be elected using: (1) the precinct method under Section 36.059, Water Code; or (2) the county commissioners precinct method described by Subsection (b) of this section. (b) Under the county commissioners precinct method, one director shall be elected by the voters of the entire district at large and one director shall be elected from each county commissioners precinct by the voters of that precinct. A candidate shall indicate on an application for a place on the ballot the precinct the candidate seeks to represent or that the candidate seeks to represent the district at large. (c) Notwithstanding Section 36.059, Water Code, a municipal corporation in the district that is part of one precinct may be included, in whole or in part, in another precinct. SECTION 4. EFFECTIVE DATE. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
