A BILL TO BE ENTITLED
AN ACT
relating to the office of county attorney of Pecos County, to the
office of district attorney for the 83rd Judicial District and to
the office of district attorney for the 112th Judicial District.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 43.141(a), Government Code, is amended
to read as follows:
(a) The voters of Brewster, Jeff Davis, Pecos, Presidio, and
Upton counties elect a district attorney for the 83rd Judicial
District.
SECTION 2. Section 43.152(a), Government Code is amended to
read as follows:
(a) The voters of Crockett, Reagan, Sutton, and Upton
counties the 112th Judicial District elect a district attorney for
the 112th Judicial District who represents the state in that
district court only in those counties.
SECTION 3. Chapter 45, Government Code, is amended by
adding Section 45.285 to read as follows:
Sec. 45.285. Pecos County. (a) The county attorney of
Pecos County shall perform the duties and have the powers conferred
on district and county attorneys by general law. The county
attorney of Pecos County shall exclusively represent the state in
all matters pending before the district and inferior courts of
Pecos County.
(b) Notwithstanding any other law, the county attorney of
Pecos is entitled to continue receiving the statutory supplement
provided to county attorneys under Chapter 46 of the Texas
Government Code.
SECTION 4. This Act takes effect January 1, 2005.
