A BILL TO BE ENTITLED
AN ACT
relating to the cost of an attendance credit under the school finance system. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 41.093, Education Code, is amended by adding Subsections (d) and (e) to read as follows: (d) Notwithstanding Subsections (a) and (c), for purposes of this section, in computing the cost of an attendance credit for a district, delinquent maintenance and operations taxes collected in a tax year subsequent to the tax year in which the taxes were due are multiplied by a percentage equal to the percentage determined by: (1) dividing the total amount required to purchase attendance credits under this section for the school year in which the taxes were due by the district's total maintenance and operations tax revenue for that year; and (2) multiplying the quotient by 100. (e) Subsection (d) applies only to computing the cost of an attendance credit for the 2003-2004 or 2004-2005 school year. Subsection (d) and this subsection expire September 1, 2005. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
