A BILL TO BE ENTITLED

AN ACT

relating to the allotment of funds for programs for gifted and 
talented students in certain school districts.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 42.156, Education Code, is amended by 
amending Subsection (c) and adding Subsection (c-1) to read as 
follows:
	(c)  Except as provided by Subsection (c-1), not [Not] more 
than five percent of a district's students in average daily 
attendance are eligible for funding under this section.
	(c-1)  This subsection applies only to a district for which 
the total cost of attendance credits under Section 41.093 for a 
school year equals or exceeds 50 percent of the district's total 
maintenance and operations tax revenue for that year.  Not more than 
10 percent of a district's students in average daily attendance are 
eligible for funding under this section.
	SECTION 2.  This Act takes effect September 1, 2003.
