A BILL TO BE ENTITLED
AN ACT
relating to validation of certain acts and proceedings of the City of McAllen relating to the creation of two boards of trustees for the management of its international bridges. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 367, Transportation Code, is amended by adding Section 367.069 to read as follows: Sec. 367.069. (a) All governmental acts and proceedings of the City of McAllen authorizing the creation of the two boards of trustees, providing for the management and control of its international bridge system comprising the Hidalgo-McAllen-Reynosa International Bridge and the Anzalduas International Crossing, are validated as of the dates on which they occurred. (b) This section does not validate any governmental act or proceeding that, under the statues of this state in effect at the time the act the proceeding occurred, constitute an offense punishable as a misdemeanor for a felony. (c) This section does not apply to any matter than the effective date of this section: (1) is involved in litigation if the litigation ultimately results in the matter being held invalid by a final judgment of a court of competent jurisdiction; or (2) has been held invalid by a final judgment of a court of competent jurisdiction. SECTION 2. (a) This Act takes effect September 1, 2003. (b) The change in law made by this Act apply to an administrative proceeding under Sec. 376.069 (a), as amended by this Act, that is initiated on or after the effective date. An administrative proceeding under that section that is in progress on the effective date of this Act is governed by the law applicable to that proceeding in effect before the effective date, and that law is continued in effect for that purpose.
