A BILL TO BE ENTITLED
AN ACT
relating to the regulation of the location of, and aggregate piles
maintained by the operators of, portable rock crushing machines.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 382, Health and Safety
Code, is amended by adding Section 382.0592 to read as follows:
Sec. 382.0592. LIMITATIONS RELATED TO OPERATIONS OF MOBILE
ROCK CRUSHERS. (a) This section applies only to the location and
operation of a rock crusher that may be moved and operated in
different locations.
(b) A rock crusher may not be operated less than one mile
from any recreational area or from a residence or other structure
that is occupied or used by a person other than the operator of the
rock crusher or the owner of the property on which the rock crusher
is operated.
(c) Aggregate, rock, or gravel piles maintained in the
vicinity of a rock crusher may not exceed a height of 15 feet.
(d) The commission shall adopt rules to implement this
section.
SECTION 2. This Act takes effect September 1, 2003.
