A BILL TO BE ENTITLED
AN ACT
relating to the probationary period of a person appointed to a
beginning position in a fire department in certain municipalities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 143.027, Local Government Code, is
amended by amending Subsection (a) and adding Subsection (a-1) to
read as follows:
(a) A person appointed to a beginning position in the [fire
or] police department must serve a probationary period of one year
beginning on that person's date of employment as a [fire fighter,]
police officer[,] or academy trainee.
(a-1) A person appointed to a beginning position in the fire
department must serve a probationary period of not less than one
year or more than two years beginning on that person's date of
employment as a fire fighter or academy trainee. The length of the
probationary period may be established by ordinance. If the length
of the period is not established by ordinance, the commission after
consulting with the head of the fire department shall establish the
length of the period.
SECTION 2. The change in law made by this Act applies to the
probationary period of a person appointed to a beginning position
in a fire department on or after the effective date of this Act. The
probationary period of a person appointed to a beginning position
in a fire department before the effective date of this Act is
governed by the law in effect on the date the person was appointed,
and the former law is continued in effect for that purpose.
SECTION 3. This Act takes effect September 1, 2003.
