A BILL TO BE ENTITLED

AN ACT

relating to the methodology of computing municipal franchise 
compensation payments for electric utilities in a region for which 
customer choice has been delayed.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Subchapter A, Chapter 33, Utilities Code, is 
amended by adding Section 33.0085 to read as follows:
	Sec. 33.0085.  PAYMENT METHODOLOGY UNDER CERTAIN FRANCHISE 
AGREEMENTS.  Section 33.008 does not apply to an electric utility 
operating in a power region for which the commission has delayed 
customer choice, and the electric utility shall make franchise 
compensation payments as provided by the franchise agreement 
between the electric utility and the municipality.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
