A BILL TO BE ENTITLED

AN ACT

relating to the funding of toll facilities.                                   
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 222.103(h), Transportation Code, is 
amended to read as follows:
	(h)  Money granted by the department each federal fiscal year 
under this section may not exceed 30 percent of the obligation 
authority under the federal-aid highway program that is distributed 
to this state in that year.  This subsection does not apply to money 
expended on a toll facility from which the department receives all 
toll revenue collected.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
