A BILL TO BE ENTITLED
AN ACT
relating to an intercollegiate athletic fee for students at Prairie View A&M University. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 54, Subchapter E. Education Code is amended by the addition of Section 54.5392, as follows: Section 54.5392. Intercollegiate Athletic Fee; Prairie View A&M University. (a) If approved by a vote of students enrolled at Prairie View A&M University, the board of regents of The Texas A&M University System may charge students enrolled at the university an intercollegiate athletics fee no to exceed $10 per semester credit hour. (b) The maximum amount to be paid by a student shall not exceed the amount payable for 13 semester credit hours, regardless of the number of semester credit hours taken. (c) The fee may not be initially assessed unless approved by a majority vote of the students participating in a general student election held for that purpose. (d) The fee authorized by this section may be increased from year to year by no more than five percent per semester credit hour if such increase is approved by the legislative body of the student government at the university. Any increase from year to year that exceeds five percent must be approved by a majority vote of student government at the university. Any increase from year to year that exceeds five percent must be approved by a majority vote of students participating in a general student election held for that purpose. (e) The fee authorized by this section is not counted in determining the maximum student services fee which may be charged under Section 54.503 of this subchapter. (f) This act shall be effective as of September 1, 2003, and shall apply to any intercollegiate athletic fee charged to students enrolling for the fall semester of 2003. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate affected his Act takes effect September 1, 2003.
