A BILL TO BE ENTITLED
AN ACT
relating to highway beautification
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 391.252(a), Transportation Code, is
amended to read as follows:
(a) A [Subsequent to the effective date of this subchapter,]
a person may not erect an off-premise sign that is adjacent to and
visible from:
(1) U.S. Highway 290 between the western city limits
of the city of Austin and the eastern city limits of the city of
Fredericksburg;
(2) State Highway 317 between the northern city limits
of the city of Belton to the southern city limits of the city of
Valley Mills;
(3) State Highway 16 between the northern city limits
of the city of Kerrville and Interstate Highway 20;
(4) U.S. Highway 77 between State Highway 186 and
State Highway 44;
(5) U.S. Highway 281 between State Highway 186 and
Interstate Highway 37;
(6) State Highway 17 between State Highway 118 and
U.S. Highway 90;
(7) State Highway 67 between U.S. Highway 90 and
Farm-to-Market Road 170;
(8) Farm-to-Market Road 170 between State Highway 67
and State Highway 118;
(9) State Highway 118 between Farm-to-Market Road 170
and State Highway 17;
(10) State Highway 105 between the western city limits
of the city of Sour Lake to the eastern city limits of the city of
Cleveland;
(11) State Highway 73 between the eastern city limits
of the city of Winnie to the western city limits of the city of Port
Arthur;
(12) State Highway 21 between the southern city limits
of the city of College Station and U.S. Highway 290; [or]
(13) a highway located in:
(A) the Sabine National Forest;
(B) the Davy Crockett National Forest; or
(C) the Sam Houston National Forest;
(14) State Highway 281 within the county of Bexar;
(15) State Highway 87 within the county of Bexar;
(16) State Highway 81 within the county of Bexar;
(17) State Highway 90 within the county of Bexar;
(18) State Highway 16 within the county of Bexar;
(19) Interstate Highway 35 within the county of Bexar;
(20) Interstate Highway 10 within the county of Bexar;
or
(21) US Highway 37 within the county of Bexar;
SECTION 2. Section 216.001, Local Government Code, is
amended by adding Subsection (d) to read as follows:
(d) This subchapter does not allow the relocation or
reconstruction of a billboard in violation of Section 398.002,
Transportation Code.
SECTION 3. Section 216.901(a), Local Government Code, is
amended to read as follows:
(a) Subject to Chapter 398, Transportation Code, a [A]
home-rule municipality may license, regulate, control, or prohibit
the erection of signs or billboards by charter or ordinance.
SECTION 4. Section 391.001(10), Transportation Code, is
amended to read as follows:
(10) "Outdoor advertising" means an outdoor sign,
display, light, device, figure, painting, drawing, message,
plaque, poster, [billboard,] or other thing designed, intended, or
used to advertise or inform if any part of the advertising or
information content is visible from the main-traveled way of the
interstate or primary system. The term includes a sign, display,
light, device, figure, painting, drawing, message, plaque, or
poster displayed on a billboard, as defined by Section 398.001. The
term does not include a sign or marker giving information about the
location of an underground electric transmission line, telegraph or
telephone property or facility, pipeline, public.
