A BILL TO BE ENTITLED
AN ACT
relating to the method of electing directors of the Coastal Bend
Groundwater Conservation District.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 1294, Acts of the 77th Legislature,
Regular Session, 2001, is amended by adding Section 9A to read as
follows:
Sec. 9A. METHOD OF ELECTING DIRECTORS IF DISTRICT ANNEXES
TERRITORY. (a) Notwithstanding Section 9 of this Act, if the
district annexes territory, the directors of the district shall be
elected according to the single-member district method as provided
by this section.
(b) The initial election under this section shall be held on
the first date provided by Section 11 of this Act that occurs after
the date the annexation of the territory is final and that allows
sufficient time to comply with any requirements of law.
(c) The board shall draw five numbered, single-member
districts for electing directors.
(d) For the conduct of the initial election under this
section, the board shall provide for one director to be elected from
each of the single-member districts. A director elected from a
single-member district represents the residents of that
single-member district.
(e) Except as provided by Subsection (h) of this section, to
be eligible to be a candidate for or to serve as director, a person
must be a registered voter in the single-member district that the
person represents or seeks to represent.
(f) A person shall indicate on the application for a place
on the ballot the single-member district that the person seeks to
represent.
(g) The directors elected at the initial election under this
section shall draw lots to determine which three of the directors
serve four-year terms and which two of the directors serve two-year
terms. At each subsequent election, the appropriate number of
directors shall be elected.
(h) The directors may revise the districts as necessary or
appropriate. The board shall revise each single-member district
after each federal decennial census to reflect population changes.
When the boundaries of the single-member districts are redrawn, a
director in office on the effective date of the change, or elected
or appointed before the effective date of the change to a term of
office beginning on or after the effective date of the change, shall
serve the term or the remainder of the term in the single-member
district to which elected or appointed even though the change in
boundaries places the person's residence outside the single-member
district for which the person was elected or appointed.
SECTION 2. This Act takes effect September 1, 2003.
