A BILL TO BE ENTITLED

AN ACT

relating to the creation, administration, powers, duties, 
functions, operations, and financing of the Johnson County Special 
Utility District.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  CREATION.  (a)  A conservation and reclamation 
district is created in Johnson, Hill, Ellis, and Tarrant counties 
to be known as the Johnson County Special Utility District.  The 
district is a governmental agency and a body politic and corporate.
	(b)  The district is created under and is essential to 
accomplish the purposes of Section 59, Article XVI, Texas 
Constitution.
	SECTION 2.  DEFINITION.  In this Act, "district" means the 
Johnson County Special Utility District.
	SECTION 3.  BOUNDARIES.  The district includes all the 
territory contained in the following described area:

Beginning at the intersection of US Highway 67 and FM 2331 
approximately 7 miles southwest of the City of Cleburne in Johnson 
County and on the southwest side of the certified service area (CCN 
# 10081);

THENCE, westerly along a line approximately 7,851 feet along the 
center of US Highway 67 to a point for a corner ;

	SECTION 4.  FINDINGS RELATING TO BOUNDARIES.  The 
legislature finds that the boundaries and field notes of the 
district form a closure.   A mistake in the field notes or in copying 
the field notes in the legislative process does not affect the 
organization, existence, or validity of the district, the right of 
the district to issue bonds or refunding bonds or pay the principal 
and interest on bonds, or the legality or operation of the district 
or its governing body.
	SECTION 5.  FINDING OF BENEFIT.  The legislature finds that 
all of the land and other property included within the boundaries of 
the district will be benefited by the works and projects that are to 
be accomplished by the district under powers conferred by Section 
59, Article XVI, Texas Constitution, and that the district is 
created to serve a public use and benefit.
	SECTION 6.  POWERS.  (a)  The district has all of the rights, 
powers, privileges, authority, functions, and duties provided by 
the general law of this state, including Chapters 49 and 65, Water 
Code, applicable to special utility districts created under Section 
59, Article XVI, Texas Constitution, except as specifically limited 
by this Act, as follows:
		(1)  for six years from the effective date of this Act, 
the district shall limit the exercise of its powers related to the 
provision of public water utility service to territory located 
within the boundaries of the district or as authorized by 
Certificate of Convenience and Necessity No. 10081;
		(2)  for six years from the effective date of this Act 
the district may not provide wastewater service, solid waste 
service, fire-fighting service, or stormwater, flood control, and 
drainage services and may not convert to or otherwise become a 
municipal utility district, absent the express written consent of 
any city with extraterritorial jurisdiction that overlaps the 
district's boundaries.
	(b)  Nothing in this Act shall be construed to impair the 
district's ability or right to obtain tax-exempt bond financing or 
a state sales tax exemption or impair any other right or benefit 
under Chapter 65, Water Code, or other applicable law consistent 
with the powers granted by this Act and not in conflict with the 
prohibitions of this Act.
	(c)  On or after six years from the effective date of this 
Act, if the district desires to exercise any of the powers 
restricted by this Act, the district must file an application with 
the Texas Commission on Environmental Quality, if allowed by the 
law in existence at that time, to exercise those additional powers.  
In addition to filing an application seeking expansion of its 
powers, the district must apply for a Sewer Certificate of 
Convenience and Necessity if the district desires to provide retail 
wastewater service.  Notice and a copy of an application for 
expansion of powers shall be provided to each municipality the 
jurisdiction of which, including extraterritorial jurisdiction, 
overlaps the district's boundaries, in addition to complying with 
any other applicable notice requirements.  If a municipality that 
is entitled to the notice required by this section timely files a 
request for a contested case hearing within 60 days after receipt of 
the notice, the Texas Commission on Environmental Quality shall 
directly refer the application to the State Office of 
Administrative Hearings for a contested case hearing.
	(d)  This Act prevails over any provision of general law that 
is in conflict with or inconsistent with this Act.
	(e)  The rights, powers, privileges, authority, functions, 
and duties of the district are subject to the continuing right of 
supervision of the state to be exercised by and through the Texas 
Commission on Environmental Quality.
	SECTION 7.  REGULATORY CONFLICTS.  If a municipality asserts 
regulatory authority, including water quality standards, over any 
geographic area lying within the jurisdiction of the district, the 
regulation of the municipality shall control over that of the 
district in the event of a regulatory conflict with the district.  
This section does not apply to potable water quality standards or to 
disputes relating to retail water utility service areas.
	SECTION 8.  BOARD OF DIRECTORS.  (a)  The district is 
governed by a board of not less than five and not more than 11 
directors.  There shall be nine initial directors.
	(b)  Temporary directors serve until initial directors are 
elected under Chapters 49 and 65, Water Code.
	(c)  Initial directors serve until permanent directors are 
elected under Chapters 49 and 65, Water Code.
	SECTION 9.  TEMPORARY BOARD OF DIRECTORS.  (a)  The temporary 
board of directors is composed of:
	W. J. Dickens III;                                                             
	Kay Day;                                                                       
	Harry Shaffer;                                                                 
	Al Slimp;                                                                      
	Diane H. Johnson;                                                              
	Gene Petross;                                                                  
	Bobby C. Shuler;                                                               
	Ken Barnes; and                                                                
	Lonnie Richburg.                                                               
	(b)  The temporary directors shall execute their official 
bonds and take their official oath of office.  The bonds shall be 
approved by the board of directors of the district and each bond and 
oath shall be filed with the district and retained in its records.
	(c)  If a temporary director fails to qualify for office, the 
temporary directors who have qualified shall appoint a person to 
fill the vacancy.  If at any time there are fewer than five 
qualified temporary directors for any reason, the Texas Commission 
on Environmental Quality shall appoint the necessary number of 
directors to fill all vacancies on the board.
	SECTION 10.  CONFIRMATION AND INITIAL DIRECTORS' ELECTION.  
(a)  The temporary board of directors shall call and hold an 
election to confirm establishment of the district and to elect the  
initial directors as provided by Chapters 49 and 65, Water Code.
	(b)  Section 41.001(a), Election Code, does not apply to an 
election held under this section.
	(c)  The temporary board of directors shall determine the 
method for determining the initial term of each person on the 
initial board of directors.  The terms must be clearly stated on the 
ballot for the confirmation and directors' election.
	(d)  The initial board of directors shall file with the Texas 
Commission on Environmental Quality an order canvassing the 
confirmation election returns not later than 30 days after the 
election.
	(e)  Upon a successful confirmation election, the assets, 
debts, and contractual rights and obligations of Johnson County 
Rural Water Supply Corporation shall be transferred to the 
district, and dissolution proceedings of Johnson County Rural Water 
Supply Corporation shall be commenced within 30 days after such 
transfer.
	(f)  Upon a successful confirmation election and dissolution 
of Johnson County Rural Water Supply Corporation, Certificate of 
Convenience and Necessity No. 10081 shall be issued by the Texas 
Commission on Environmental Quality in the name of the district.
	(g)  If the establishment of the district has not been 
confirmed at an election held under this section before the second 
anniversary of the effective date of this Act, this Act expires on 
that date.
	SECTION 11.  ADOPTING RULES.  The district may adopt and 
enforce reasonable rules that fall within the district's statutory 
authority.
	SECTION 12.  FINDINGS RELATING TO PROCEDURAL REQUIREMENTS.  
(a)  The proper and legal notice of the intention to introduce this 
Act, setting forth the general substance of this Act, has been 
published as provided by law, and the notice and a copy of this Act 
has been furnished to all persons, agencies, officials, or entities 
to which they are required to be furnished by the constitution and 
laws of this state, including the governor, who has submitted the 
notice and Act to the Texas Commission on Environmental Quality.
	(b)  The Texas Commission on Environmental Quality has filed 
its recommendations relating to this Act with the governor, 
lieutenant governor, and speaker of the house of representatives 
within the required time.
	(c)  The general law relating to consent by political 
subdivisions to the creation of a conservation and reclamation 
district and the inclusion of land in the district has been complied 
with, and all requirements of the constitution and laws of this 
state and the rules and procedures of the legislature with respect 
to the notice, introduction, and passage of this Act are fulfilled 
and accomplished.
	SECTION 13.  This Act takes effect immediately if it 
receives a vote of two-thirds of all the members elected to each 
house, as provided by Section 39, Article III, Texas Constitution.  
If this Act does not receive the vote necessary for immediate 
effect, this Act takes effect September 1, 2003.
