A BILL TO BE ENTITLED
AN ACT
relating to the confirmation of state and district officers
appointed by the governor.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 652, Government Code, is amended by
adding Subchapter C to read as follows:
SUBCHAPTER C. CONFIRMATION OF GUBERNATORIAL APPOINTMENTS
Sec. 652.041. APPLICATION OF SUBCHAPTER. This subchapter
applies to any state or district office to which Section 12, Article
IV, Texas Constitution, applies.
Sec. 652.042. CONFIRMATION BY HOUSE OF REPRESENTATIVES.
(a) An appointment of the governor to a vacancy to a state or
district office must be with the advice and consent of two-thirds of
the members of the house of representatives present.
(b) The procedures prescribed by law for confirmation of an
appointment to which this section applies by the senate apply to
confirmation of an appointment by the house under this subchapter.
SECTION 2. This Act takes effect September 1, 2003, and
applies only to a vacancy that occurs on or after that date.
