HOUSE CONCURRENT RESOLUTION
WHEREAS, current Texas law does not provide for the payment
of disability compensation for the wage loss sustained by an
individual unemployed because of sickness or injury unless
worker's compensation insurance is available; and
WHEREAS, Texas also does not provide disability compensation
for any individual who is unable to work due to the sickness or
injury of a family member, or the birth, adoption or foster care
placement of a new child; and
WHEREAS, California has an established program for providing
for the payment of disability compensation for the wage loss
sustained by an individual unemployed because of sickness or
injury; and
WHEREAS, California passed Senate Bill 1661 on September 26,
2002 that provides disability compensation for any individual who
is unable to work due to the sickness or injury of a family member,
or the birth, adoption or foster care placement of a new child; and
WHEREAS, California has established a state Disability Fund
that is financed by means of employee contributions at specified
rates; now, therefore, be it
RESOLVED, that the 78th Legislature directs the Legislative
Budget Board to study establishing a Family Temporary Disability
Insurance and Leave Program modeled upon California law.
