A JOINT RESOLUTION
proposing a constitutional amendment relating to the structure, powers, and duties of the State Board of Education. BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 8, Article VII, Texas Constitution, is amended to read as follows: Sec. 8. The [Legislature shall provide by law for a] State Board of Education consists of[, whose] members [shall be appointed or] elected from districts contiguous with the boundaries of congressional districts in this state who[in such manner and by such authority and] shall serve staggered four-year [for such] terms[as the Legislature shall prescribe not to exceed six years]. The [said] board shall: (1) administer and direct public education in this state; (2) appoint a commissioner of education to serve at the will of the board; (3) appoint board officers, including the presiding officer; and (4) perform such duties as may be prescribed by law. SECTION 2. This proposed constitutional amendment shall be submitted to the voters at an election to be held November 4, 2003. The ballot shall be printed to permit voting for or against the proposition: "The constitutional amendment relating to the structure, powers, and duties of the State Board of Education."
