A JOINT RESOLUTION
proposing a constitutional amendment to allow a local option
election to legalize or prohibit the sale of mixed beverages in
certain special districts.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 20, Article XVI, Texas Constitution, is
amended by adding Subsection (d) to read as follows:
(d) The legislature may enact a law to allow the qualified
voters in an improvement district that is a political subdivision
to determine by a majority vote whether the sale of mixed alcoholic
beverages in a food service establishment shall be prohibited or
legalized in the prescribed limits of the district.
SECTION 2. This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 4, 2003.
The ballot shall be printed to permit voting for or against the
proposition: "The constitutional amendment to allow an improvement
district that is a political subdivision to hold a local option
election to legalize or prohibit the sale of mixed alcoholic
beverages in a food service establishment in the district."
