A BILL TO BE ENTITLED
AN ACT
relating to the financing of assessments performed by the Texas School for the Blind and Visually Impaired and the Texas School for the Deaf. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter B, Chapter 30, Education Code, is amended by adding Section 30.026 to read as follows: Sec. 30.026. REIMBURSEMENT FOR ASSESSMENT OF DISTRICT AND OPEN-ENROLLMENT CHARTER SCHOOL STUDENTS. On request, a school district or open-enrollment charter school shall reimburse the Texas School for the Blind and Visually Impaired for the actual cost of assessing a student not seeking admission to the school whom the district or the open-enrollment charter school refers to the school for assessment. SECTION 2. Subchapter C, Chapter 30, Education Code, is amended by adding Section 30.058 to read as follows: Sec. 30.058. REIMBURSEMENT FOR ASSESSMENT OF DISTRICT AND OPEN-ENROLLMENT CHARTER SCHOOL STUDENTS. On request, a school district or open-enrollment charter school shall reimburse the Texas School for the Deaf for the actual cost of assessing a student not seeking admission to the school whom the district or the open-enrollment charter school refers to the school for assessment. SECTION 3. This Act applies beginning with the 2003-2004 school year. SECTION 4. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
