S.B. No. 100AN ACT relating to carbon monoxide detectors in certain child-care facilities and family homes. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter C, Chapter 42, Human Resources Code, is amended by adding Section 42.060 to read as follows: Sec. 42.060. CARBON MONOXIDE DETECTORS. (a) In this section, "carbon monoxide detector" means a device that detects and sounds an alarm to indicate the presence of a harmful level of carbon monoxide gas. (b) Except as provided by Subsection (d), each day-care center, group day-care home, and family home must be equipped with carbon monoxide detectors in accordance with department rules. (c) The department by rule shall prescribe requirements regarding the placement, installation, and number of carbon monoxide detectors and maintenance procedures for those detectors. (d) A day-care center is exempt from the carbon monoxide detector requirements prescribed by this section if the day-care center is located in a school facility that is subject to the school facility standards adopted by the commissioner of education under Section 46.008, Education Code, or similar safety standards adopted by the board of a local school district. SECTION 2. (a) This Act takes effect September 1, 2003. (b) Notwithstanding Subsection (a) of this section, a day-care center, group day-care home, or family home is not required to be equipped with carbon monoxide detectors as required by Section 42.060, Human Resources Code, as added by this Act, before January 1, 2004.______________________________ ______________________________ President of the Senate Speaker of the House I hereby certify that S.B.
