A BILL TO BE ENTITLED
AN ACT
relating to the tuition charged certain foreign students attending a public junior college in a county bordering Mexico. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 54.060, Education Code, is amended by adding Subsection (b-1) to read as follows: (b-1) The governing board of a junior college district that operates a public junior college in a county that borders the United Mexican States may waive the foreign student tuition prescribed by this chapter for a student who is a resident of the United Mexican States, who registers for lower division courses at that public junior college, and who demonstrates a financial need after the financial resources of the foreign student and the student's family are considered. A foreign student for whom the junior college district waives the foreign student tuition under this subsection shall pay tuition at the rate charged Texas residents who reside outside the junior college district. The coordinating board shall adopt rules governing the determination of financial need of students under this subsection. SECTION 2. The change in law made by this Act applies beginning with tuition charged for the 2003 fall semester. SECTION 3. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
