A BILL TO BE ENTITLED
AN ACT
relating to the authority of certain hospital districts to provide
services to certain persons.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 281.046, Health and Safety Code, is
amended to read as follows:
Sec. 281.046. DISTRICT RESPONSIBILITY FOR MEDICAL AID AND
HOSPITAL CARE. (a) Beginning on the date on which taxes are
collected for the district, the district assumes full
responsibility for furnishing medical and hospital care for
indigent and needy persons residing in the district.
(b) A person may not be considered to reside in the district
if the person established the person's residency in the district
solely to obtain medical or hospital care from the district.
SECTION 2. Subchapter D, Chapter 281, Health and Safety
Code, is amended by adding Section 281.074 to read as follows:
Sec. 281.074. AUTHORITY TO PROVIDE SERVICES TO CERTAIN
PERSONS. The district may provide nonemergency medical treatment
and care to a person who would otherwise be ineligible under 8
U.S.C. Section 1621(a), as amended, provided that:
(1) only local money is used to provide the treatment
and care; and
(2) the district establishes a cost-sharing system for
persons receiving treatment and care through the district.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2003.
