A BILL TO BE ENTITLED
AN ACT
relating to a fee to fund women's athletic programs of The
University of Texas System.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 65, Education Code, is
amended by adding Section 65.48 to read as follows:
Sec. 65.48. SUPPORT OF WOMEN'S ATHLETICS. (a) The board
shall impose a fee of $1 to be added to the admission charge for any
intercollegiate athletic event held on the campus of or on other
property under the control of any component institution of higher
education of the system.
(b) The board shall adopt rules relating to the collection
and administration of the fee imposed under this section.
(c) The money collected from the fee must be used by the
system to support women's athletics at component institutions of
the system.
(d) The board shall distribute the money collected under
this section among the component institutions in proportion to the
number of women competing in intercollegiate athletics at each of
those institutions.
(e) Money distributed to an institution under this section
may be used by the institution for scholarships, equipment,
facilities, travel, lodging, or training for women's
intercollegiate athletics at the institution.
(f) An institution may not reduce the amount of other money
the institution spends to support women's intercollegiate
athletics as a result of the institution's receipt of money under
this section.
SECTION 2. This Act takes effect September 1, 2003, and
applies only to a ticket sale or other admission charge to an
intercollegiate athletic event if the ticket sale is made or the
admission charge is collected on or after the effective date of this
Act.
