A BILL TO BE ENTITLED

AN ACT

relating to the authority of a county development district to 
impose an ad valorem tax and provide infrastructure for a 
residential subdivision.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 383.061, Local Government Code, is 
amended by adding Subsections (d) and (e) to read as follows:
	(d)  The district may not impose an ad valorem tax.                     
	(e)  The district may construct, finance, or otherwise 
provide infrastructure for a residential subdivision only if the 
infrastructure serves the purpose of attracting visitors and 
tourists to the county.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2003.
