COMMITTEE AMENDMENT NO. 1 By: Shapleigh
Amend S.B. No. 441 by adding the following appropriately
numbered section and renumbering sections accordingly:
SECTION ____. Subchapter B, Chapter 22, Transportation Code,
is amended by adding Section 22.027 to read as follows:
Sec. 22.027. MUNICIPAL PERMISSION FOR GROUND TRANSPORTATION;
OFFENSE. (a) In this section, "ground transportation business"
means the transportation by motor vehicle of persons or baggage for
compensation, and includes transportation by a bus service.
(b) A person commits an offense if, within the boundaries of
an airport operated by a home-rule municipality, the person:
(1) solicits ground transportation business without
the permission of the municipality, if required; or
(2) engages in ground transportation business without
the permission of the municipality, if required.
(c) An offense under this section is a Class B misdemeanor.
A BILL TO BE ENTITLED
AN ACT
relating to the transportation by motor vehicle of persons within
the boundaries of certain airports; creating an offense.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter D, Chapter 22, Transportation Code,
is amended by adding Section 22.0815 to read as follows:
Sec. 22.0815. (a) In this section, "ground transportation
business" means the transportation by motor vehicle of persons or
baggage for compensation.
(b) A person commits an offense if, within the boundaries of
an airport operated or controlled by a joint board for which the
constituent agencies are populous home-rule municipalities, the
person:
(1) solicits ground transportation business without
the permission of the joint board, if required; or
(2) engages in ground transportation business without
the permission of the joint board, if required.
(c) An offense under this section is a Class B misdemeanor.
SECTION 2. This Act takes effect September 1, 2003.
