A BILL TO BE ENTITLED
AN ACT
relating to the penalty for certain speeding offenses. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter H, Chapter 545, Transportation Code, is amended by adding Section 545.366 to read as follows: Sec. 545.366. PENALTY: EXCEEDING SPEED LIMIT BY 25 MILES PER HOUR OR MORE. A person who commits an offense under this subtitle by exceeding an applicable maximum speed limit by 25 miles per hour or more shall be punished by a fine of not less than $200 or more than $500. Notwithstanding Section 542.402(a), a municipality or county, at the end of the municipality's or county's fiscal year, shall send to the comptroller for deposit in the state treasury an amount equal to $200 for each fine collected by the municipality or county for violations to which this section applies. Money deposited under this section may be used only to carry out the traffic safety program established under Chapter 723. SECTION 2. (a) The change in law made by this Act applies only to an offense committed on or after the effective date of this Act. For the purposes of this section, an offense is committed before the effective date of this Act if any element of the offense occurs before that date. (b) An offense committed before the effective date of this Act is governed by the law in effect when the offense was committed, and the former law is continued in effect for that purpose. SECTION 3. This Act takes effect September 1, 2003.
