A BILL TO BE ENTITLED
AN ACT
relating to the application of the public information law to certain emergency preparedness plans of a county. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter C, Chapter 552, Government Code, is amended by adding Section 552.149 to read as follows: Sec. 552.149. EXCEPTION: CERTAIN EMERGENCY PREPAREDNESS PLANS OF COUNTY. An emergency preparedness plan of a county is excepted from the requirements of Section 552.021 if: (1) the emergency preparedness plan contains sensitive information relating to privately owned critical infrastructures or facilities; and (2) the safety or security of those infrastructures or facilities could be jeopardized by disclosure of the emergency preparedness plan. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2003.
